Balsam Hillβ’ Three-Year Limited Warranty Coverage for Artificial Christmas Trees
Balsam Hill is pleased to offer a limited three-year product warranty on regular and sale-priced artificial Christmas trees. The Balsam Hill Three-Year Limited Warranty guarantees the quality of our artificial Christmas treesβ factory installed lights (excluding burned-out bulbs), frame, foliage, hinges, and tree stand. Any repair or replacement of defects in those parts are fully covered by the warranty within the specified time frame. Please note this warranty only applies to artificial Christmas trees. All other products are covered by our Premium Guarantee. All clearance trees are covered by aΒ 60-Day Clearance Limited Warranty.
If you have problems with or need help with your tree, we would recommend that you first try to resolve the issue using the troubleshooting section of theΒ Assembly, Use, and Care Instructions. If that does not solve your problem or you would prefer to speak with a Customer Loyalty Specialist, please contact us via our toll-free Customer Care Line atΒ 888-552-2572Β or through on-site Live Chat. We will assist you by troubleshooting the problem and identifying an appropriate solution. This may occasionally include requesting a photo of the issue.
Please do not attempt self-repair, other than as shown in instructions that we have provided or as directed by a Customer Loyalty Specialist, as this may damage the tree further and subsequently void the warranty.
If during the Warranty Period you submit a claim to Balsam Hill in accordance with this warranty, we will, at our option:
- repair the tree as soon as possible with a part or parts that are equivalent to new in reliability. If your tree is no longer available for sale on our website or as been redesigned, the part(s) may have to be manufactured after the holiday season;
- replace the tree with either a style that is identical, or the closest compatible style available; or
- give you a credit towards a replacement tree if we cannot repair or replace your tree.
Due to the seasonal nature of our business, part and/or product availability can change rapidly during the months of November and December, and we will work with you to find a solution.
Exclusions From the Balsam Hillβ’ Limited Warranty for Trees
The warranty excludes burned-out bulbs and normal wear and tear, and will be voided in the cases of damage due to misuse, neglect, intentional alteration, or other events beyond our reasonable control. A warranty may not be transferred and applies only to the original owner of the tree.
Balsam Hillβ’ 60-Day Clearance Limited Warranty
Balsam Hill offers a 60-day limited warranty on all clearance trees. The limited warranty on clearance trees is the same as that described on this page for all other artificial Christmas trees, but it only lasts for 60 days. For this reason, we encourage you to open and inspect clearance items upon delivery.
Other Important Details
If your tree is defective or damaged, we may send you a user-installable part and ask you to install the part in accordance with instructions that we provide. If this occurs, the replacement part assumes the remaining term of the warranty or 60 days from the date of replacement or repair, whichever provides longer coverage for you.
The three-year and sixty-day limited warranties described above (collectively, the βWarrantyβ) give you specific legal rights, and you may also have other rights which vary from state to state. The Warranty is voided in cases of product use outside the United States, Canada, or Puerto Rico.
We may change the availability of the Warranty at our discretion, but any changes will not be retroactive.
OTHER THAN THE WARRANTY DESCRIBED ABOVE, WE DISCLAIM ANY STATUTORY OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND THOSE REGARDING HIDDEN OR LATENT DEFECTS. That said, some States do not allow limitations on how long an implied warranty lasts, so the limitation may not apply to you.
THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE LIABILITY FOR ANY BREACH OF THE WARRANTY. OUR LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT, NOR SHALL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.
SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. TO THE EXTENT THAT THE LAW WHICH APPLIES TO YOU DOES NOT ALLOW US TO IMPOSE CERTAIN LIABILITY LIMITATIONS, EXCLUSIONS OR DISCLAIMERS, OUR WARRANTIES ARE LIMITED IN SCOPE AND DURATION TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW.
